The Pesticides Act and the Regulation respecting permits and certificates for the sale and use of pesticides provide for mechanisms requiring that most users and sellers of pesticides comply with a system of permits and certificates.

Permits

A permit is required for activities relating to the sale and use of pesticides. Every application for a permit or for modification of a permit shall be made on the form provided by the Minister which shall include the following information:

  • The applicant’s identification
  • The class and the subclasses of the permits referred to
  • The name and address of the place of business or establishment located in Québec for which the permit is applied.

Remplacement of Permit

Every application for the remplacement of a lost, stolen or deteriorated permit shall be made on the form provided by the Minister.

Certificates

Activities relating to the sale and use of pesticides must be performed by employees holding a certificate or working under the supervision of a certified employee present in the workplace. The certificate holder must have his certificate in his possession when selling or using pesticides. Every application for a certificate or for modification of a certificate shall be made on the form provided by the Minister which shall include the following information:

  • The applicant’s identification
  • The class and subclasses of the certificates referred to in the application.

The application for a certificate or for modification of a certificate shall also be accompanied by an attestation of the successful completion of the examination prescribed or recognized by the Minister.

Remplacement of Certificate

Reciprocity of a certificates issued by another Canadian provinces or territories

Under certain conditions, the Pesticides Act allows Québec to offer reciprocity for pesticide sales or use certificates issued by other Canadian provinces or territories. To proceed to approval, the Ministère is required to ensure that the applicant possesses knowledge that is equivalent to requirements enabling the requested Québec category or sub-category certificate to be issued.

The following criteria are used when approving an application for reciprocity with respect to a certificate issued by another Canadian province or territory:

Reciprocity may be declined if the provincial or territorial examination was passed by the applicant more than five years prior to the date of the request.

The following documentation accompanying requests for reciprocity of a certificate issued in another Canadian province or territory are to be submitted to the Direction régionale de l’analyse et de l’expertise de Montréal, de Laval, de Lanaudière et des Laurentides:

  • A fully-executed certificate application form
  • The provincial or territorial document (licence or certificate) that corresponds to the Québec certificate
  • The required fees for the 5-year validity period of the certificate
